This article presents an analysis of the changes that have taken place in the legal and jurisprudential development of memory in the face of the transitional justice mechanisms that have been presented in Colombia. With this, it was possible to compile the information that allowed to evidence such transformations allowing to establish an analytical category between a minimalist approach and a maximalist approach that allows to understand the duty of the State in the transitional processes regarding memory and therefore, the implications regarding its object of protection and the subjects of law that seeks through its fulfillment to achieve a stable and lasting peace. In accordance with this exposition, the text manages to outline a framework of relationship of the legal-political transformations of the regimes of memory in transitional justice as compliance with the constitutional foundation of peace in Colombia. © 2024 Universidad Nacional Autonoma de Mexico.
