This article presents an analysis of the jurisprudential development of the Constitutional Court on comprehensive reparation as a fundamental right of the ethnic population as victims of the armed conflict and subject of special protection according to the stipulation of Law 1448 of 2011. The foundations of the Constitutional Court as an interpretative body are reconstructed to evidence the incidence of peacebuilding as a hermeneutic canon of the Colombian system of norms in accordance with the qualitative and quantitative criteria of the social and democratic rule of law presented by its own jurisprudence. The research was carried out through a hermeneutic approach that allowed the review of the Constitutional Court’s rulings to analyze the units of meaning described in the jurisprudence and reconstruct the analytical categories constituting the fundamental right to integral reparation for the ethnic population in a given context such as the Colombian conflict. © 2024, University Institution of Envigado.
