Abstract
Las personas procesadas ven vulnerados sus derechos fundamentales al momento de practicárseles intervenciones corporales sin su consentimiento; con el fin de alcanzar la verdad a toda costa, se hace uso de la fuerza y del trato cruel e inhumano y esto conlleva a que el ejercicio de la justicia se desvirtué.
Es importante proteger los Derechos Fundamentales del procesado y existen reglas absolutas que protegen dichos Derechos que no admiten excepción. Se deben establecer límites a las actuaciones de las autoridades, cuando realizan intervenciones corporales con el propósito de crear fuentes probatorias, evitando el trato cruel, inhumano y degradante. Con este trabajo se pretende dar respuesta acerca de cuáles son las cargas y obligaciones procesales que deben motivar la procedencia o viabilidad, para afectar el derecho fundamental de la no autoincriminación del imputado en la obtención de la prueba.
