This article´s purpose is to provide to provide research to the Colombian criminal procedural history prior to the existence of procedural codes by examining the structure of the ordinary criminal trials in the Nueva Granada Viceroyalty. Specifically, this research was carried out by analyzing all the trials for theft, the most common felonies in the Santa Fe jurisdiction. This research led to arguing that the mixed procedural structure of Spanish origin was kept during the studied timeframe, besides, it showed a growing autonomy and a formal adjustment of the procedures despite the informal and socially diffuse characteristics that remained in place. Este artículo busca aportar a la historia procesal penal colombiana anterior a la existencia de códigos procesales al examinar la estructura de los juicios criminales ordinarios en el virreinato de la Nueva Granada. Específicamente, la investigación se llevó a cabo por medio del análisis de todos los juicios por hurtos, los delitos más comunes en la jurisdicción de Santa Fe. Con base en este análisis, el artículo argumenta que la estructura procesal mixta de origen castellano se mantuvo a lo largo del periodo estudiado, además de observarse una creciente autonomía y ajuste formal de los procesos a pesar de los rasgos informales y socialmente difusos que permanecían en la práctica. También se muestra que la práctica de la declaración indagatoria comenzó a llevarse a cabo a finales del periodo colonial a través de la actividad judicial de la Real Audiencia en primera instancia.
 
Este artigo visa contribuir para a história processual penal colombiana anterior a existência dos códigos de processos ao examinar a estrutura dos juízos criminais comuns no Vice-Reino da Nova Granada. Especificamente, este trabalho foi realizado a partir de análises de todos os juízos por furtos y de delitos mais comuns na jurisdição de Santa Fé. Com base a esta análise, o artigo argumenta que a estrutura processual mista de origem castellano manteve-se ao longo do período estudado, além de observar-se uma crescente autonomia e ajuste formal dos processos apesar das características informais e socialmente difusa que permaneciam na prática. Também é mostrado que a prática da declaração indagatória começou a ser realizada ao final do período colonial através da atividade judicial da Real Audiência em primeira instancia.
