El allanamiento a cargos como una modalidad de preacuerdo conforme la jurisprudencia de la Corte Suprema de Justicia

Abstract
La Ley 906 de 2004 establece al menos dos tipos de proceso, entre ellos, uno fundado en la renuncia voluntaria, debidamente informada y con asistencia de un defensor, por parte del imputado o acusado, y que resulta ser de carácter abreviado con relación al proceso ordinario, lo que implica la dimisión por parte del procesado al derecho de no auto incriminarse y al de tener un juicio público, oral, contradictorio, concentrado, imparcial, con inmediación de las pruebas y sin dilaciones injustificadas, con el fin de obtener una sustancial rebaja de pena. Para la aceptación de cargos existen dos figuras diferentes, como lo son el allanamiento a cargos y los preacuerdos, en razón a las consecuencias jurídicas que tienen estas en el proceso penal, sin embargo, a partir de la decisión de la Corte Suprema de Justicia con radicado 39831 del 27 de septiembre de 2017, el allanamiento a cargos se empezó a entender como una modalidad de acuerdo y no una simple manifestación unilateral de sometimiento a la justicia por parte del imputado o acusado sin contraprestación ninguna. Decisión judicial, que ante la congestión judicial que presenta el país, ha ido en contra de la economía procesal ya que, procesos que podrían terminar anticipadamente por una simple aceptación de cargos, se han convertido en uno ordinario, por no contar el procesado, en algunas ocasiones, con la forma de reintegrar, por lo menos, el cincuenta por ciento del valor equivalente al incremento percibido.
