Abstract

With that purpose, this article analyzed the regulation of the employment contract in Cuba for engaging the challenges that must be faced to rule the working relationships within the micro, small and medium-sized enterprises. No meio de um processo de atualização e reforma se reconheceu no sistema jurídico cubano, a existência legal de empresas médias, pequena e micro, o que leva a questionar se a atual legislação trabalhista, projetada para uma época diferente, está preparada para enfrentar esta realidade. Com este propósito, analisou-se a regulamentação do contrato de trabalho em Cuba para verificar os desafios pelo qual esta deve passar para normatizar as relações de trabalho nas micros, pequenas e médias empresas. A utilização de métodos de pesquisa científica como análise-síntese, indutivo-dedutivo, histórico-jurídico, teóricojurídico e exegético-analítico, permitiu sistematizar como evolui no país a política em torno aos atores econômicos não governamentais e examinar os desafios que têm a regulamentação do contrato de trabalho, para poder adaptar-se as particularidades das micro, pequenas e médias empresas no território, sem descuidar a proteção dos direitos dos trabalhadores.
 
En medio de un proceso de actualización y reforma se reconoció en el ordenamiento jurídico cubano, la existencia legal de empresas de mediana, pequeña y micro escala, lo que conduce a cuestionar si la vigente legislación laboral, diseñada para un escenario distinto, está preparada para enfrentar esta realidad. Con este propósito, se analizó la regulación del contrato de trabajo en Cuba para constatar los desafíos que esta debe afrontar para normar las relaciones de trabajo en las micro, pequeñas y medianas empresas. El empleo de métodos de investigación científica como el análisis-síntesis, el inductivo-deductivo, el histórico-jurídico, el teórico-jurídico y el exegético-analítico, permitió sistematizar cómo ha evolucionado en el país la política en torno a los actores económicos no estatales y examinar los retos que tiene la regulación del contrato de trabajo, para adaptarse a las particularidades de las micro, pequeñas y medianas empresas en la nación, sin descuidar la protección de los derechos de los trabajadores.
